FBI owns certain Tor nodes, they've caught people. Even though they can't use the Tor traffic in court sometimes, they can use it to find other evidence that one has forgotten to hide. Then they can fuck them over. Search parallel construction

Even if one uses a non USA based VPN + Tor, you only need to slip up once and you're fucked.
