They could probably knock it down to a malicious communication charge but because magistrates in England have to vote guilty when they believe that the incident occurred a solicitor representing him can’t try to tug on their heartstrings to get a not guilty verdict like they could with a jury (who aren’t working and thus can’t be dismissed over seemingly wrong verdicts like a magistrate can).
If the evidence suggests he did it and the magistrates voted not guilty because they pitied him they could lose their jobs (although theoretically a guy in a care home could run an insanity argument ig he’s got mental health difficulties and such like).

His defence lawyer could have made a motion on dismiss on the grounds that charging a care home resident with such a charge is not in the public interest which could have got the case chucked out by the court but they are out of time now and magistrates are cucks who won’t be willing to lose their jobs voting not guilty just because the charge is ridiculous.
But yes charging a care home resident with harassment is stupid and if his lawyer was anything other than some trashy degenerate legal aid one they would have tried getting the charges dismissed on an actual motion.
The problem is legal aid lawyers aren’t paid by making motions in England- they are only paid a retainer and their trial costs- and that means it was in the lawyer’s interest to abandon his client to go to trial where now a motion is not possible sadly.
